California zoning: how it works and what you can build

California layers hundreds of locally administered zoning codes underneath an unusually aggressive state housing-law regime — RHNA housing-element mandates, the Housing Accountability Act, and a wave of density-legalizing statutes like SB 9, SB 35, and AB 2011 — that increasingly overrides local zoning outright when a city falls out of compliance.

How zoning works in California

California's constitution gives charter cities broad home-rule authority over municipal affairs, including land use, while general-law cities and all counties operate under the state's Planning and Zoning Law. Every California city and county must adopt a general plan and a zoning ordinance consistent with it, but the more consequential state layer for developers is housing law: California's Housing Element Law requires every jurisdiction to plan for its share of the state's Regional Housing Needs Allocation (RHNA) and maintain a state-certified housing element, and the Housing Accountability Act sharply limits a locality's ability to deny or downsize a compliant housing project.

Since 2017, California has passed a dense sequence of state statutes that legalize housing types local zoning previously prohibited, regardless of the underlying local ordinance. SB 35 (2017) created streamlined, ministerial approval for multifamily projects in cities that haven't met their RHNA housing-production targets. SB 9 (2021) legalized duplexes and lot splits by right on most single-family-zoned parcels statewide. AB 2011 (2022) created a ministerial, CEQA-exempt approval pathway for affordable and mixed-income housing on commercially zoned land. The statewide Accessory Dwelling Unit law requires ministerial approval of ADUs and junior ADUs on virtually any residential lot in the state.

For developers, this means the 'zoning' answer for a California parcel is rarely just the local ordinance — it's the local ordinance filtered through whichever of these state overlays applies, and a city found out of RHNA compliance can trigger the so-called 'builder's remedy,' under which the Housing Accountability Act effectively suspends the city's ability to deny a qualifying housing project on inconsistency-with-zoning grounds alone. Local zoning still governs day-to-day entitlement in compliant jurisdictions, but every California feasibility analysis now has to check state-law eligibility layered on top of the base zoning district.

California has no single authoritative statewide parcel-zoning GIS layer — parcel data originates with each county assessor and zoning boundaries with each city or county planning department — though the California State Geoportal aggregates many state-agency GIS layers useful for site screening.

California zoning — common questions

Can I build a duplex on a single-family lot in California?
In most cases, yes: SB 9, effective January 1, 2022, allows by-right duplex development and lot splits on most single-family-zoned parcels statewide, subject to conditions like owner-occupancy affidavits and exclusions for parcels with recent tenant occupancy, rent-controlled units, or environmental hazards. Local zoning can still apply objective development standards, but it cannot categorically ban the SB 9 duplex or lot split.
What is California's 'builder's remedy'?
It's the practical effect of the Housing Accountability Act (Gov. Code § 65589.5) when a city's housing element is not state-certified: in that state, the city loses much of its ability to deny a qualifying housing project on the grounds that it's inconsistent with local zoning or the general plan, effectively suspending normal zoning control until the housing element is brought into compliance.
Can I put housing on a commercially zoned parcel in California without a rezoning?
