Terms of Service

Who you are contracting with

The service is operated, and any report is sold, by One Telos Ltd, a company registered in England and Wales (company number 13191707), registered office 81 Clayhall Avenue, Ilford, Essex, United Kingdom, trading as RealDevelop (“we”, “us”). You can reach us at team@realdevelop.io.

The service

The service comprises the free cited zoning reference on this site, the RealDevelop application at app.realdevelop.io, and paid parcel-level products including zoning analysis reports. We may add, change or withdraw features; where a change materially reduces something you have already paid for, we will tell you.

What a report is — and is not

A RealDevelop report is an independent, informational analysis of public zoning ordinances and public parcel records, with the sections it relied on cited so every figure can be checked. It exists to help you decide whether a site is worth pursuing and to prepare the questions you take to the jurisdiction.

It is not:

• legal advice — we are not attorneys, and nothing in the service is a substitute for advice from a licensed attorney in the relevant jurisdiction;
• a certified zoning determination or zoning verification letter — only the municipality itself can issue the document a lender or title company will accept as the jurisdiction’s own position on a parcel;
• a survey, title search or environmental assessment — zoning outcomes can turn on recorded easements, prior variances, pending amendments and other facts that are not visible in the public records we analyse.

Every project should be confirmed against the current adopted code and with the jurisdiction before money moves. Decisions you take, including decisions to purchase, finance or develop property, remain yours.

Business use only

The service is provided for business purposes — underwriting, developing, brokering, designing or advising on real estate. By using it you confirm you are acting in the course of a business and not as a consumer.

Accounts

You are responsible for keeping your credentials secure and for activity under your account. Give us accurate contact information; it is how report delivery and corrections reach you.

Purchases, payment and refunds

Prices are as shown at the point of purchase, in the currency shown, exclusive of any applicable taxes. Payment is processed by Stripe; we do not hold your card details. Reports are generated and delivered digitally, normally immediately, and a purchase applies to the specific parcel identified at checkout.

If a purchased report fails to generate, or you believe it is materially defective, contact us at team@realdevelop.io within 14 days of purchase and we will re-run it or refund it. Because reports are delivered immediately on generation, there is otherwise no right to cancel after delivery.

Data and accuracy

Our data is produced from public ordinances, statutes and records, which change without notice and are not always internally consistent. We cite our sources precisely so our work is checkable, and we correct errors when they are reported — but the service and all reports are provided “as is” and “as available”, without warranty that they are complete, current or fit for any particular transaction. Intellectual property and your licence

We own the service, its data compilations and the report format. A purchased report is licensed to you, non-exclusively, for your internal business purposes in connection with the parcel it covers — including sharing it with your project’s professional team (lender, counsel, architect, partners). You may not resell, republish or systematically extract our data or reports.

Acceptable use

Do not scrape or bulk-extract the service, probe or disrupt it, use it to build a competing dataset, or misrepresent a RealDevelop report as a document issued or certified by a municipality or by anyone other than us.

Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited under applicable law.

Otherwise:

• we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or losses arising from decisions to purchase, finance, develop or not develop property; and
• our total aggregate liability arising out of or in connection with the service in any 12-month period is capped at the fees you paid us in that period.

Suspension and termination

We may suspend or terminate access for breach of these terms. You may stop using the service at any time. Clauses which by their nature should survive — including the report disclaimers, licence limits and liability clauses — survive termination.

Changes to these terms

We may update these terms; the date above is the date of the current version. Material changes will be flagged on this page, and continued use after a change constitutes acceptance.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them or from the service.
